Byrne indicated that when he attempted to restrain in the back straight on a number of occasions the horse became awkward in its action and laid out and appeared to resent being restrained. He said that the horse weakened in the home straight and was disappointing. He added that the horse also laid in under pressure in the home straight and he was obliged to stop riding and straighten on a number of occasions when tiring.

Raced with its head in the air when being restrained in the early stages. When asked to comment on the horse’s performance, J. Byrne indicated that at no stage did the horse travel comfortably, racing with its head in the air in the early stages and near the 850m, when following MOGUL, that horse shifted in and made contact with the running rail. He felt that this caused his mount to shy and lose ground and become very awkward in its action. He indicated that from that point onwards the horse did not respond to his riding and was very disappointing in the run to the line.

The start of the race was delayed when the horse became fractious in the barriers. After undergoing an veterinary examination mare was cleared to start. Was buffeted between runners near the 400m and as a result lost ground. Jockey D. Browne, rider of VALFIERNO, pleaded guilty to a charge of careless riding, in that he allow his mount to shift in when not sufficiently clear of runners to his inside, that being ESSAKA, tightening the running of that horse and taking it in on to AMERICAN HERO, causing the riders of both ESSAKA and AMERICAN HERO to have to take hold and check their mounts approa
