SUPPLEMENTARY REPORTS
 
From Sunshine Coast Friday 1 June 2018 – Race 6:
 
Stewards today concluded an adjourned inquiry into the running and handling of FIGHTING TEO in this event. After taking further evidence from trainer K. Kemp and jockey D. Browne, stewards also tabled evidence of vision of the horse’s previous race starts and stewards’ reports from these events. Stewards, after having concerns that jockey Browne had failed to comply with a change of tactics, which was to ride FIGHTING TEO forward from its wide barrier, jockey Browne explained that the gelding began very awkwardly and made heavy contact with the barrier partition, causing the horse to lose ground. He added that he attempted in the first 50m to comply with these instructions, however the horse did not respond to his riding and therefore he restrained the horse to obtain cover at the tail of the field. Stewards accepted jockey Browne’s explanation as to his tactics during this stage of the event. Stewards also raised with jockey Browne further concerns from the 600m onwards, and after hearing evidence from jockey Browne were not satisfied with his explanation that FIGHTING TEO was awkward in its action from the 500m and jockey Browne was subsequently found guilty of a charge under AR. 135(b), being:
 
“The rider of every horse shall take all reasonable and permissible measures throughout the race to ensure that his horse is given full opportunity to win or to obtain the best possible place in the field.”

The particulars of the charge being:
 
1.    For a distance approaching the 500m, when having been afforded clear running behind DREAM CAPTAIN and TOLAI MERI, he failed to ride with sufficient purpose and vigour to attempt to improve his position when it was both permissible and reasonable at this stage of the race.
 
2.    Furthermore, when following TOLAI MERI when leaving the 500m until approaching the 100m, he failed to ride with any purpose and vigour to improve his position when this action was permissible and, given your proximity to the finish of the event, reasonable in the circumstances.
 
3.    Additionally, it was, in the opinion of the stewards, unreasonable for him to ride without purpose and vigour when afforded clear running over the final stages of the race when clearly permissible in the circumstances.
 
Stewards particularise that these failures to fulfil reasonable actions, which were clearly permissible to him, resulted in FIGHTING TEO not being afforded the opportunity to win or finish in the best possible position.”
 
After hearing penalty submissions jockey Browne’s license to ride in races was suspended for a period of 2 months to commence midnight July 1, 2018 and to conclude September 1, 2018. In assessing penalty stewards took into account the good riding record of jockey Browne, previous penalty precedents, the seriousness of the charge and the detrimental effect that rides of this nature have on the industry.
 
Stewards advised trainer K. Kemp that they were satisfied that he was not complicit in jockey Browne’s tactics.
 
From Doomben Saturday 23 June 2018 – Race 5:
 
Near the 900m TROMMELSCHLAGEN had to be checked from the heels of PROM QUEEN, which itself had to be steadied from the heels of COLOSIMO, which shifted in when not properly clear. P. Hammersley, the rider of COLOSIMO, was reprimanded.
 
Race 1: SKY THOROUGHBRED CENTRAL MAIDEN PLATE – 2060M
 
C’MOME PADDYREILLY – Raced ungenerously when being restrained in the early and middle stages.
 
CAMBRIDGE DON – Raced wide in the early stages.
 
ERROL – Blundered on jumping and lost significant ground.
 
NIGHT WHISPER – Overraced on heels when the pace was only steady after leaving the 1600m. Forced wider from the 800m and raced wide without cover from that point onwards.
 
ASTANA – Began awkwardly.
 

 
Race 2: HAMILTON HOTEL MAIDEN PLATE – 1200M
 
As apprentice J. Murphy was late arriving on course, apprentice B. Nothdurft was substituted as the rider of AMERICAN LOVE. Apprentice Murphy was fined $100 under AR. 85B for failing to fulfil his engagement.
 
MEANER – Steadied near the 800m to avoid the heels of KEREMA MORI, which shifted in.
 
REACHER – Raced three wide without cover.
 
MILITARY SPY – Became unbalanced near the 400m. A post-race veterinary examination revealed no significant findings.
 
AMERICAN LOVE – Kicked by another runner behind the barriers, examined by the veterinary surgeon and cleared to start. Became awkward when bumped by another runner near the 800m. Laid in under pressure in the straight.
 
PORTUGUESE TART – Held up rounding the home turn.
 
SATYRICON – Raced three wide with cover.
 
EVENING – Slow to begin. Raced greenly throughout.
 
Race 3: ASCOT GREEN QTIS 2YO MAIDEN PLATE – 1350M
 
The declaration of correct weight was delayed to enable L. Cheshire and trainer K. Rae to view the footage of the start to determine whether PATSYS LASS had been afforded a fair start. After viewing the video, neither party wished to lodge an application.
 
DOSS – Raced three wide without cover.
 
ENTERPRISE PRINCE – Overraced at heels during the middle stages.
 
MISHANI BRAVEHEART – Lost the off hind plate in running.
 
PIERRE BIZEL – Slow to begin.
 
PATSYS LASS – Jumped away awkwardly and lost ground.
 
Following the running of this event the track was downgraded to SOFT 5.
 
Race 4: BECOME A BRC MEMBER QTIS 2YO MAIDEN PLATE – 1110M
 
COME ALIVE – Slow to begin.
 
ONE FOR BETTY – Proved difficult to load, delaying the start. A warning was placed on the horse’s manners.
 
DRAGON INTHE NORTH – Raced three wide without cover.
 
Race 5: GIDDY UP CLUB QTIS 2YO MAIDEN PLATE – 1110M
 
PENASQUITO – Raced three wide without cover throughout.
 
CLAIRVUE SPIRIT – Steadied to avoid heels near the 900m and then overraced until approaching the 600m.
 
RED CHASE – Checked when tightened for room at the start.
 
SAPPHIRE GIFT – Slow to begin. Raced greenly in the straight and laid out under pressure.
 
Following the running of this event the track was downgraded to SOFT 6.
 
Race 6: EVENTS AT BRC CLASS 3 H’CAP – 1650M
 
Stewards acceded to a request by trainer S. Kendrick to scratch COPYWRITER at 1:52 pm due to the track downgrade to SOFT 6.
 
MEWSTONE ROCK – Slow to begin.
 
OVERLAP – Had to be checked when tightened for room at the start. Dipped at the 1400m.
 
NOSSUH – Hampered on jumping away.
 
Race 7: RACEZONE APPRENTICES RACE CLASS 3 PLATE – 1350M
 
ARANCINI – Raced wide throughout. Inclined to lay out rounding the home turn.
 
SON OF A BRUT – Shifted in abruptly when obliged to race in restricted room near the 700m, made contact with the running rail and lost ground as a result.
 
TIVOLI STREET – Slow to begin. Held up for clear running shortly after straightening, clipped heels and stumbled.
 
KUBIS – Raced wide without cover throughout.
 
ARAZONA – Held up for clear running rounding the home turn.
 
DAPPER ONE – Raced wide without cover. Hung in under pressure in the home straight.
 
O’REILLY CYRUS – Slow to begin. A post-race veterinary examination revealed that the mare had bled from both nostrils. Connections were advised that the mare would be ineligible to start for 3 months, and prior to resuming racing must gallop satisfactorily over 1000m in the presence of a steward.
 
SOL WITNESS – A post-race veterinary examination revealed that the mare had a cut heel on the off hind leg.
 
MARSEILLE EN FLEUR – Had difficulty securing clear running in the early stages of the home straight before shifting back to the inside. Steadied and shifted out to avoid heels near the 100m.
 
Race 8: TEDDY BEARS PICNIC RACEDAY BENCHMARK 70 H’CAP – 2240M
 
BRONZEGATE, which reared and became cast in its barrier, was declared a late scratching at 3:32 pm. On the announcement of correct weight, stewards ordered that all monies invested on BRONZEGATE be refunded, with the following deductions to apply to wagers placed prior to scratching time:
 
3 cents in the dollar for the win #3
6 cents in the dollar for place of winner #3
3 cents in the dollar for 2nd place #5
7 cents in the dollar for 3rd place #13
 
MAXWELL, which was in the adjoining stall and was struck during the incident, was removed from its stall, examined by the veterinary surgeon and deemed suitable to race.
 
GLEN ORD – Held up rounding the home turn.
 
EVOLO – Bumped near the 1300m. Hung in under pressure over the concluding stages and proved difficult to ride.
 
MAXWELL – Began awkwardly and was bumped at the start.
 
TISANI GREY – Tightened for room near the 2000m and had to be steadied. Became unbalanced when racing in restricted room near the 1300m. Finished tailed off. A post-race veterinary examination revealed that the gelding had cardiac arrhythmia. Trainer K. Kemp was advised that the horse must trial satisfactorily and that a veterinary clearance, including the results of an ECG, must be produced prior to the gelding being permitted to race again.
 
Race 9: ALLAN REARDON BENCHMARK 70 H’CAP – 1200M
 
HAPPY HOOVES – J. Byrne explained that he was aware that the winner, EL SHADAY, was shifting in near the winning post and for this reason he stopped riding two strides prior to the post. Whilst stewards were satisfied that jockey Byrne’s riding did not cost him 3rd place, he was nonetheless reminded of his obligation to ride his mounts out to the end of the race.
 
CLANG’S VICTORY – Raced three wide without cover.
 
OUR JAMAICA – Began awkwardly.
