GENERAL
Jockey B. Pengelly made claim to the engagement to ride Cylinder Beach on Saturday, 31 December in the Bernborough Handicap in that he had the belief that if the horse was weighted at 55 kilograms he would retain the ride. Stewards interviewed trainer Miss Desley Forster, who acted on behalf of the owners, and agreed that there had been discussion as to whether B. Pengelly would ride the horse. However the decision from the owners was that they engage J. Byrne.  Stewards, acting under Local Rule 52, ruled that jockey J. Byrne should ride the horse however that jockey B. Pengelly  should be paid a fee of a win or losing ride on the horse.
