SUPPLEMENTARY REPORT

Stewards resumed an adjourned inquiry which was opened on Saturday 24 June 2017 with respect to the circumstances surrounding Apprentice A. Spinks being dislodged from ROUND MOUNTAIN GAL near the 200m in Race 1 on that date.. The inquiry was adjourned on the day in question to allow Apprentice Spinks to provide evidence at the inquiry as he had been transported to hospital for observation as a result of this incident.
 
At todayys resumed inquiry evidence was taken from Apprentice A. Spinks, jockeyys advocate Mr K. Waller, Apprentice R. Goldsbury (FREE BILLY), and apprentice Goldsburyys master, Mr. Mark Currie.
 
After considering the evidence tendered by the parties involved, and viewing the patrol footage, and taking into account their own observations, Stewards found that after being struck with the whip near the 200m FREE BILLY shifted out resulting in ROUND MOUNTAIN GAL clipping the heels of that runner, blundering and dislodging Apprentice Spinks.. Stewards were however of the view that immediately after being struck with the whip, Apprentice Goldsbury straightened FREE BILLY to prevent it from shifting further ground outwards.. As Stewards were satisfied that Apprentice Goldsburyys actions could not be deemed careless in all the relevant circumstances, they took the matter no further and deemed the matter as a racing incident.

Stewards opened an inquiry into an incident which occurred during the running of Heat 8 at the Toowoomba Turf Club jumpouts on Tuesday 1 August 2017.. Stewards took submissions from Jockey N. Tomizawa, Apprentice N. Keal, Trainer K. Kemp (Apprentice Kealls master) and jockeyys advocate K. Waller in relation to this incident.
 
Jockey N. Tomizawa subsequently pleaded guilty to a charge under rule AR. 175(q), in that during the running of Heat 8 at the Toowoomba Turf Club jumpouts on 1 August 2017 he did misconduct himself, in that near the 200m he deliberately struck the horse ridden by Apprentice N. Keal with his whip on two occasions.
 
Apprentice N. Keal also pleaded guilty to a charge under rule AR. 175(q), in that during the running of Heat 8 at the Toowoomba Turf Club jumpouts on 1 August 2017 he did misconduct himself, in that near the 150m he deliberately reached over with his right arm making contact with the left arm of Jockey N. Tomizawa.
 
In assessing penalty, Stewards accepted that there was no malice intended on the part of either rider, however the actions of both riders presented a safety issue to themselves, their mounts and the other riders in this Heat.. Both riders were therefore subsequently fined $400.
 
Race 1: 3RD TIME LUCKY LEON WISE CLASS 1 HHCAP 1300M
 
WINE BARREL Stood flat-footed at the start and lost ground, and as a result settled further back in the field than anticipated.. Laid in for the majority of the event, and proved difficult to ride out in the home straight.
 
MUSTARRID On return to scale, Stewards questioned jockey N. Tomizawa regarding the performance of the gelding which had drifted noticeably in the betting and appeared to be disappointing in todayys event.. Jockey Tomizawa advised that Trainer B. Currie had told him that, in the lead up to todayys event, the horse had taken a fitness benefit from its first up win, and his instructions were to ride the horse positively in the early stages to obtain a forward position.. Jockey Tomizawa added that the gelding travelled comfortably when leading in todayys event, and that in running he expected his mount to be difficult to beat.. Jockey Tomizawa went on to say that when placed under pressure from the 500m, his mount failed to quicken as expected and, in his opinion, raced flat which he could only attribute to the horse being second up today.. Trainerrs representative Mark Currie could offer no explanation for the disappointing performance of the gelding as the horse had worked well in preparation for tonightts event. A post-race veterinary examination revealed no apparent abnormalities.. A swab sample was taken from the gelding.
 
WAINUI GOLD Began awkwardly.
 
DEVLANN Slow into stride.. On return to scale, jockey J. Kehoe reported that after being slow to begin the gelding never travelled comfortably and was hard ridden throughout the event and, in his opinion, proved disappointing today.
 
DODGE THE PRESS Shifted in abruptly to avoid the heels of a tiring runner near the 150m.
 
ROCK NN RHUMBA On return to scale, Stewards questioned jockey Beau Appo and Trainer K. Kemp with respect to ROCK NN RHUMBA settling in a forward position in todayys event.. Jockey Appo advised that the gelding began well and, with blinkers back on today, travelled strongly in the early stages and, in his opinion, he was able to obtain a position outside the lead with relative ease.. Jockey Appo added that the manner in which he rode the gelding was consistent with the instructions issued by Trainer K. Kemp prior to the event.. Mr Kemp advised that two starts prior to todayys event the gelding had settled in a forward position and at its last start he had expected the horse to obtain a similar position, however the horse failed to muster early speed and as a result settled further back than anticipated.. Mr Kemp added that with the addition of blinkers to the horsees gear today, he was not surprised to see the horse racing in a prominent position.. Stewards noted the explanations.
 
Race 2: JOCKEY CELEBRATION DAY CLASS 3 HHCAP 1200M
 
BIG DOLLARS Raced 3 wide with cover throughout the event.. On return to scale, apprentice S. Sweeney reported that the gelding was forced to race wide throughout and, given that the horse was first up from a significant spell today, she expected her mount to gain a significant fitness benefit from this event.
 
STAR HERO Raced 3 wide without cover throughout the event.
 
TIMEES UP Disappointed for a run approaching the 100m, and was held up for some distance from this point.
 
Race 3: VANDERFIELD BENCHMARK 60 HHCAP 2150M
 
RUBY GURU Raced wide from the 1100m.
 
BAY RAIDER Held up and unable to improve from the 500m until entering the home straight.
 
JEEWAN Steadied to avoid heels shortly after the start.
 
MCGILL Began awkwardly.
 
SLALOM As Apprentice N. Fazackerley was unable to claim down to his declared riding weight, Apprentice M. Schrapel was substituted as rider.. Apprentice Fazackerley was fined $100.. Prior to the event, connections advised Stewards that it was the intention for the horse to be ridden in a forward position today if circumstances permit. After being slow into stride, the horse settled at the rear of the field.. Apprentice M. Schrapel allowed his mount to stride forward to take up a more forward position when racing keenly near the 1200m, and as a result was forced to race 3 wide for the remainder of the event.
 
REGULARITY On passing the winning post on the first occasion, the gelding was steadied to avoid the heels of BAY RAIDER (N. Tomizawa) which was taken in by NATIONAL JEWEL (G. Steele) which shifted in when not completely clear.. Jockey G. Steele was reprimanded as result of this incident.. Raced keenly in the early and middle stages.. Became unbalanced for a short distance near the 1300m when placed in restricted room to the inside of MCGILL (C. Small) which shifted in.. Jockey C. Small was advised to exercise more care in similar circumstances in the future.
 
Race 4: PRO-CLEAR MAIDEN PLATE 1200M
 
LE CHARIOTEER Began awkwardly.
 
OUR NICK Bumped on jumping away.
 
PRINCE SILENCE Bumped at the start and raced wide for the majority.
 
HEART OF A REBEL Began awkwardly.
 
ROTINDY Raced wide throughout.
 
ALSIDEREUS As jockey Brad Appo was indisposed due to illness, A. Allen was substituted as rider.. Steadied to avoid the heels of another runner, which was laying in despite the best efforts of its rider, at the 150m.
 
Race 5: QUEENSLAND ELECTRICAL SOLUTIONS CLASS 2 HHCAP 1050M
 
No racing incidents.
 
Race 6: VALE BRIAN MALT HHCAP 1625M
 
LATINO LOVER Began awkwardly and lost ground.
 
FLYING PRINCE Raced keenly and ungenerously whilst being restrained near the 1300m, and shifted wider on the track.
 
JOURNALIST Raced wide from the 800m.
 
MAJESTIC SHADOW Raced keenly in the early and middle stages.. Raced in restricted room for a short distance near the 900m.
 
REAL LUCKY Steadied from heels approaching the 1100m.
 
BENICSTRESS As jockey Beau Appo became indisposed due to illness following his ride in Race 5 today, jockey A. Badger was substituted as rider.. Commenced to overrace shortly after the start, and proved difficult to restrain in the middle stages of the event.
 
Race 7: NEIL MANSELL TRANSPORT BENCHMARK 70 HHCAP 1625M
 
JUST AS LOYAL Apprentice S. Sweeney was fined $200 for using the whip on more than 5 occasions prior to the 100m.
 
SCRAP COPPER Scratched at 7.10pm following a phone call from Trainer L. Hatch who advised that the horse was found to be lame prior to being transported to the track.
 
FELIX Commenced to hang out and shifted wider on the track rounding the turn near the 1200m.. On return to scale, jockey K. Yoshida reported at as a result of his mount hanging out at that point in the race, the gelding proved difficult to ride and for that reason he allowed the horse to stride forward, however this resulted in the horse racing wider for the remainder of the event.. Trainer L. Bryant will be advised that a warning will be placed on the horsees racing manners.
