Training Assistance Fund - Terms & Conditions

Definitions

  1. Applicant means the legal entity applying for financial assistance under the Fund.
  2. Application means either the online formal application submitted by the Applicant, or the online formal application completed by Racing Queensland for and on behalf of the Applicant, and includes supporting documentation submitted with the Application. 
  3. Approval Date means the date Racing Queensland approves the Applicant’s Application for the Grant. 
  4. Approved Funding means the funding amount approved by Racing Queensland. 
  5. Business Days are weekdays from Monday to Friday, excluding public holidays in Brisbane, Queensland. 
  6. Decision Maker is Racing Queensland, or any person acting with the authority of, or on behalf of Racing Queensland, for the purpose of making a decision to approve an Application for a Grant. 
  7. Disaster Event are the flooding events that have occurred in North Queensland affecting those LGA’s listed in the Application, from1/12/2025 to 1/06/2026 for which the Application for a Grant is being made. 
  8. Eligible Applicant means an Application that, in the discretion of the Decision Maker, meets are the Eligibility Criteria set out in the Application, or such other questions or conditions that Racing Queensland has taken into consideration due to individual circumstances.
  9. Eligibility Criteria are the criteria outlined in the Application that must be met by the Applicant to be deemed eligible for a Grant under the Fund. 
  10. Eligible Expenses means those items and expenditures associated with the business of the Applicant, including but not limited to, transport, food, forage, and bedding for animals in their care and control. 
  11. Funding Agreement means the agreement formed between Racing Queensland and the Applicant, being the Application, any supporting documentation with the Application, and the approval by Racing Queensland to a Grant to the Applicant, and such other conditions as Racing Queensland may require in its absolute discretion.
  12. Grant means the funding amount approved for payment by Racing Queensland.
  13. Grant Recipient means the legal entity receiving financial assistance or support.
  14. Local Government Authority (or LGA) means the Local Government Authorities listed in the online formal application form which the Applicant selected as part of the Eligibility Criteria to receive a Grant.

Racing Queensland reserves the right to withdraw the Training Assistance Fund (the Fund) or make changes at any time. Any changes to the Fund will be publicly advertised on Racing Queensland website - www.racingqueensland.com.au

The Applicant must lodge their Application electronically or as otherwise prescribed in the Guidelines.

Racing Queensland may request additional information and documentation from the Applicant to help determine whether the Eligibility Criteria have been met.

If the Applicant does not provide Racing Queensland with the requested information and documentation within the specified period, the Application may not be approved.

The conduct of inviting Applications does not create a binding agreement or relationship between an Applicant and Racing Queensland until the Applicant has submitted an Application and RQ has approved and paid the Grant.

For the avoidance of doubt, an Applicant is not entitled to any damages or compensation arising out of the Application process.

Grant payments will be paid via electronic funds transfer to the bank account previously notified to Racing Queensland by the Applicant.

The Applicant may withdraw their Application by submitting a formal request to withdraw. If the Grant has been paid prior to withdrawal by the Applicant, the Applicant must repay the entire Grant to Racing Queensland.

An Application may be refused if funding for the Fund has been exhausted or if the Fund has been discontinued. Racing Queensland will publish information on its website if funding for the Fund is no longer available or has been discontinued.

An Application may be declined if Racing Queensland is NOT satisfied:

a) the Applicant is an Eligible Applicant as defined in the Guidelines,

b) the Applicant has been impacted, directly or indirectly, by the Disaster Event as defined in these Terms and Conditions,

c) the Applicant has submitted all required evidentiary documentation or otherwise requested,

d) the Applicant has consented to Racing Queensland collecting, accessing, using, sharing and disclosing information in accordance with the Privacy Collection Notice,

e) the Applicant (and if the Applicant is not an individual, its owners) and the Applicant's management staff have complied with local, State and Australian laws and regulations or

f) there are no public interest issues indicating the Application should not be approved.

Racing Queensland may request additional information from the Applicant for ongoing monitoring, evaluation, reporting and compliance purposes and to support the delivery of other program funding and support services. If the Applicant receives a request for additional information under this clause, the Applicant agrees to provide that information to Racing Queensland.

The Applicant acknowledges that the Fund is subject to audit. All records related to any Approved Applications made by an Applicant must be kept for one year after the closing day for applications and be kept in a way that can be readily produced if required. Relevant records must be provided to the Queensland Government within 5 Business days of the request.

The grant funding is GST-exclusive.

If, following payment of a Grant to an Applicant, Racing Queensland:

a) becomes aware of any matter; and

b) as a result of becoming aware, reasonably determines the Eligibility Criteria were not met for that Grant,

Racing Queensland may:

d) give written notice to the Applicant of that determination; and

e) require the Applicant to repay the Grant.

Racing Queensland may set off any amounts payable by the Applicant to Racing Queensland in recovery of such Grant against a payment amount to be paid by Racing Queensland to the Applicant.

To the extent permitted by law, you release and indemnify Racing Queensland and its employees and contractors against any claim of loss or damage brought against them arising directly or indirectly from business activity funded by the Grant.

These Terms and Conditions are governed by the laws of Queensland.

Any disputes arising under these Terms and Conditions are subject to the jurisdiction of the courts of Queensland.
