Supplementary Report

From Rockhampton, 28.2.19

Stewards today concluded a matter which involved a complaint from owner Liam Goody in relation to the conduct of licensed bookmaker Mr Vince Aspinall. After considering the evidence that had been provided on 28 February, stewards  found  Mr Aspinall guilty under LR88(1), the particulars of which as a bookmaker when offering a dividend about a runner, namely Mr Attitude in Race 6 at the Rockhampton Jockey Club on Thursday, 28 February 2019, Mr Aspinall did fail to lay that dividend when demanded  by a bettor, namely Mr L. Goody. After hearing submissions in relation to penalty, Mr Aspinall was fined the sum of $700. In assessing penalty stewards took into account Mr Aspinall’s good record over 43 years of being a licensed bookmaker.

As Jockey R. Wiggins’ arrival on course was delayed to transport difficulties, riding replacements were made as per the Stewards Summary Sheet. Jockey Wiggins was subsequently reprimanded.

Following the declaration of correct weight, steward G. Meek drew to the attention of the Chairman of Stewards that a possible error had been made in identifying, AUTHADANE.  Following further investigations with trainer J. Lancaster, it was established that PLAIN ‘N’ SIMPLE, which was engaged to race in Race 7 had raced in Race 6, stewards ordered this gelding be declared a late scratching from Race 7 at 5 o’clock with the following deductions applicable.

0 cents in the dollar on the face value of win bets
3 cents in the dollar on the face value of win bets for the place
6 cents in the dollar on the face value of 2nd place bets

At  a subsequent inquiry it was established that trainer J. Lancaster had saddled the incorrect horse for Race 6 as she was of the opinion that Plain ‘N’ Simple was to race in this event and AUTHADANE was engaged for Race 7. Trainer J Lancaster pleaded guilty to a charge under AR 227(a) in that her negligence in failing to correctly identify AUTHADANE as the horse engaged in Race 6 had led to a breach of AR 99(b) as the incorrect horse had been presented to start in the relevant race. After hearing submissions on penalty stewards adjourned this matter. However acting under AR234, stewards ordered that AUTHADANE be disqualified from this event. In addition the Chairman of Stewards will provide a report pertaining to this incident to the Acting Commissioner QRIC.
