GENERAL
Rockhampton 13 December 2021.
Stewards inquired into the circumstances upon return to the mounting yard subsequent to, the running of race eight of Jockey Brad Pengelly (KASINOVA KID) handing his girth to trainer Nick Walsh who subsequently concealed it behind his back. Nick Walsh pleaded guilty to a charge under AR 229(1)(a) for performing a dishonest or improper act and was fined $1000. Brad Pengelly pleaded guilty to a charge under AR 229(1)(a) for performing a dishonest or improper act and his license to ride in races was suspended for a period of 10 days to commence midnight 26th June 2022 and to conclude Midnight the 6th July 2022. In considering appropriate penalties, stewards considered both parties’ forthright evidence, guilty pleas, clear records and the act of concealing the girth had no bearing on Jockey Pengelly weighing back in at the correct weight.
