SUPPLEMENTARY REPORT
Subsequent to ORTENSIA winning the Galaxy Stakes at Randwick during the Autumn Carnival, a urine sample was taken. The connections of ORTENSIA have now been officially notified that this sample has proved to contain irregularities and an inquiry will be conducted by Racing New South Wales stewards at a time and date to be fixed.
Mr T. Noonan, the trainer of ORTENSIA, had ZEVADA engaged in Race 1 and BE POSITIVE in Race 3 at the Eagle Farm meeting today.
Before today’s racing commenced, the Chairman of Stewards, Mr W. Birch, had a number of telephone conversations with Mr Noonan who suggested that whilst the feed given to ORTENSIA and his other runners engaged today was similar and from the same company, it was from different batches.
Before Race 1 the stewards gave consideration as to whether ZEVADA and BE POSITIVE should be allowed to start. Mr Noonan accepted it is his responsibility to ensure his runners were free of prohibited substances when presented for racing and he was confident in all the circumstances that this would be the case today. Accordingly, both ZEVADA and BE POSITIVE were permitted to run.
Subsequent to Race 1 a urine sample was taken from ZEVADA and following Race 3 a similar procedure was adopted with BE POSITIVE. Mr Noonan was told that the stewards intend taking samples from ORTENSIA this afternoon and these samples will be analysed and results known before ORTENSIA will be allowed to take her place in the Stradbroke Handicap next Saturday.
FROM DOOMBEN 29.5.10: Stewards today sought from jockey D. Oliver an explanation as to why he had departed from the track last Saturday without having first sought permission to do so in accordance with LR. 49, which clearly requires all riders to seek permission before leaving the course. D. Oliver was found guilty of a breach of this rule and was fined $300.
Jockey D. Nikolic pleaded guilty to a charge under LR. 49 of leaving the course without seeking the permission of the stewards and was fined $300.
Race 5 - Mullins Lawyers Grand Prix 3yo Group 3 Stakes - 2200m: D. Oliver, the rider of LANDLORD, was reprimanded under AR. 137(a) for permitting his mount to shift in near the 600m resulting in KEYORA (H. Bowman) having to be steadied when tightened for room between LANDLORD and ROCKET TO RIO (G. Colless).
Race 1: MITTYS PLATE - 1800m
1st – Zevada 2nd – Teary Eyed 3rd – Jackpot 4th – My Limit
JUNGLE HEAT (L. Cassidy) jumped very awkwardly with its head up and commenced to hang out, and hung out throughout.
In the early stages GUDERIAN (C. Munce) had a tendency to pull and became unbalanced when close to the heels of CAMBER D’ORSAY (C. Grylls).
BRAVE THE WAY (K. McEvoy) was obliged to race wide throughout and most of the trip was without cover.
Near the 1200m JACKPOT (M. Speers), which was overracing at the heels of ARMSTRONG JONES (T. Bell), shifted out taking CAMBER D’ORSAY wider on the track. CAMBER D’ORSAY was then obliged to race wide for the remainder of the event.
About the 100m JUNGLE HEAT, which had been hanging out, was checked when crowded by BRAVE THE WAY (K. McEvoy), which was getting in, but also being crowded slightly by ZEVADA (J. Cassidy). In view of the circumstances, no direct action was taken, however both K. McEvoy and J. Cassidy were told that riders of their experience will in future be expected to stop riding and straighten sooner than they did today.
MY LIMIT (J Byrne) was held up for clear running in the straight until leaving the 100m.
The veterinary surgeon reported that ARMSTRONG JONES was galloped on on the nearside hock and had lost its near fore plate in running.
A post-race veterinary examination of ABSENT FRIENDS (B. Shinn) revealed no significant abnormalities.
The veterinary surgeon reported that SIR KINGSFORD (S. Seamer) sustained a laceration to its nearside hind leg during the event.
A post-race veterinary examination of GUDERIAN revealed no abnormalities.
B. Shinn (ABSENT FRIENDS) said that he enjoyed a good run in the race and he thought that his horse worked into the race satisfactorily but just after straightening when put under full pressure did not respond as he thought it would and was very disappointing in the way it closed the race off.
Following the running of Race 1 the track was upgraded to GOOD 3, retrospective to the running of Race 1.
Race 2: MYER SPEAR CHIEF H’CAP - 1500m
1st – Pennacchio 2nd – La Etoile 3rd – Rockdale 4th – Secrets Untold
GO CART (M. Walker) missed the start.
HELIDECK (J. Cassidy) was a little slow away and then obliged to race wide.
LA ETOILE (D. Nikolic) also was somewhat slow to begin.
Approaching the winning post JAZZ HEART (J. Byrne) was steadied when disappointed for running between SECRETS UNTOLD (C. Munce), which shifted out slightly, and HELIDECK, which shifted in away from PENNACCHIO (D. Dunn). In the opinion of the stewards the occurrence was accidental and accordingly no action was taken.
A post-race veterinary examination of SEESAWING (R. McMahon) revealed no abnormalities.
The veterinary surgeon reported that HUMMA was lame in the off foreleg following the event. Trainer R. Heathcote was advised that he must provide a veterinary clearance for HUMMA before it races again.
A post-race veterinary examination of SOMMERSEA DRIVE revealed that the gelding had sustained a laceration to the off hind cannon. Trainer T. Miller said that following the disappointing performance of the horse today it will be immediately sent for a spell.
Race 3: PATINACK FARM DANE RIPPER STAKES - m
1st – Set For Fame 2nd – Acquired 3rd – Wealth Princess 4th – Jerezana
It was reported by B. Gillovic, the trainer of WEALTH PRINCESS, that the mare had a laceration to its tongue. WEALTH PRINCESS was examined by the Club's veterinary surgeon and cleared to race, although it will be examined again at the barriers. WEALTH PRINCESS underwent a further veterinary examination at the barriers and was cleared to start.
BARINKA (J. Byrne) and FLYING TESSIE (B. Shinn) raced wide throughout.
In the early part of the straight JEREZANA (K. McEvoy) was held up for running and then to obtain clear running was shifted in abruptly near the 300m.
The veterinary surgeon reported that FLYING TESSIE had a deep brush mark on the off hind pastern and to be exhibiting the thumps. Trainer M. Williams will be advised that a veterinary clearance must be produced before the horse races again.
Race 4: B105 BRC SIRES’ PRODUCE STAKES - 1400m
1st – Pressday 2nd – Jesse’s Girl 3rd – Levi’s Choice 4th – Smokin’ Joey
Trainer D. Payne was fined $200 under AR. 59A for failing to produce the Document of Description for BOMBAY and GIRL HUSSLER (Race 5).
On return to scale, S. Seamer, the rider of ADEBISI, placed 5th past the post by the Judge, exercised his right to view the stewards’ footage with trainer D. Forster to determine whether he had grounds to lodge a protest against the winner PRESSDAY (J. Cassidy) and/or 2nd placegetter JESSE'S GIRL (B. Shinn). After viewing the video, trainer D. Forster lodged an objection against JESSE'S GIRL being declared 2nd, alleging interference inside the final 100m. After taking evidence from all parties concerned and viewing the video, stewards found that ADEBISI was crowded for room by JESSE'S GIRL but did further establish that at this time PRESSDAY was shifting in and contributing to the tightening which was taking place. The stewards could not be satisfied that the interference suffered by ADEBISI could be wholly attributed to JESSE'S GIRL, nor could they be satisfied that the result of the race was affected in any way and accordingly the protest was dismissed and correct weight was declared on the Judge’s placings of: 2, 11, 8, 6, 1.
In the early stages FASHION (D. Nikolic) raced ungenerously and several times threw its head about when placed to the heels of SMOKIN' JOEY (D. Dunn) and shifted out.
SHADOWS IN THE SUN (D. Oliver) was obliged to race wide and without cover throughout.
Just after straightening JESSE'S GIRL shifted out in an endeavour to improve between PRESSDAY and ADEBISI. At this time ADEBISI itself shifted out slightly.
After the 200m when being ridden out, JESSE'S GIRL was inclined to get in away from PRESSDAY and raced tight on the outside of ADEBISI, however over about the last 50m both ADEBISI and JESSE'S GIRL were unnecessarily crowded by PRESSDAY (J. Cassidy) which shifted in whilst being ridden out. In all the circumstances of this incident, the stewards could not be satisfied to the required standard that J. Cassidy had a charge of careless riding to answer and accordingly a charge was not preferred, however he was severely reprimanded under AR. 137(a) and told that he must exercise more care than this in future.
A post-race veterinary examination of FROM LONDON revealed no abnormalities.
Race 5: TREASURY CASINO DAYBREAK LOVER PLATE - 1400m
1st – Girl Hussler 2nd – Tromso 3rd – Latin News 4th – Hus Der Lieften
STREETS AWAY (G. Colless) missed the start and was then steadied across behind the field to take up a position towards the rear but near the running rail.
When being steadied shortly after the start SO ANYWAY (D. Oliver) got its head up and raced most ungenerously and shifted a lot of ground. After this SO ANYWAY took up a position at the rear of the field and continued for some time to race ungenerously.
About the 1000m JOHANSKI (D. Nikolic) became unbalanced and shifted out abruptly across the heels of LAUNAY (K. McEvoy).
Rounding the turn and in the straight MISS WITH ATTITUDE (C. Lindop) was inclined to get its head on the side and lay in.
JOHANSKI (D. Nikolic) was held up for clear running until the 200m and was obliged to race in restricted room inside the 100m between DUAL CHAMBER (J. Holder) and MISS WITH ATTITUDE.
In the early part of the straight LATIN NEWS was checked when disappointed for running on the inside of TIERQUALO (Matthew Palmer) and after the 200m, in an endeavour to obtain running, LATIN NEWS was shifted out and eventually improved between GIRL HUSSLER (L. Cassidy) and HUS DER LIEFTEN (T. Angland).
GIRL HUSSLER was held up for clear running for a short distance leaving the 200m.
Race 6: GUVERA EAGLE FARM CUP - 2200m
1st – Triple Honour 2nd – Raffaello 3rd – Newport 4th – Baughurst
Trainer M. Moroney advised that CALATRAVA will be ridden in a more forward position today.
Connections advised that VISION AND POWER would be ridden more positively today with a view to taking up a more forward position than it has at its recent starts. The horse was ridden accordingly.
An inquiry into the reason for ATTALLUS (C. Munce) being unnecessarily crowded for room near the winning post on the first occasion was adjourned to a date to be fixed.
In the early stages NEWPORT (D. Nikolic) was inclined to pull when racing close to the heels of FROZONE (G. Colless).
Leaving the 600m NEWPORT raced in restricted room between VICKEZZCHARDONNAY (K. McEvoy) and PAGAN PRINCESS (B. Shinn) and as a result was unable to improve its position until near the 400m.
BAUGHURST (D. Dunn) was held up and unable to improve rounding the home turn until a point leaving the 300m.
Just after straightening RAFFAELLO (S. Arnold) had to be steadied and shifted across the heels of NEWPORT to find running and go forward.
About the 300m FROZONE was momentarily unbalanced when awkward between VISION AND POWER (J. Cassidy) and CABEZA (D. Oliver).
A post-race veterinary examination of ATTALLUS revealed that it was lame in the off fore fetlock and had lost its near fore plate.
Race 7: TREASURY CASINO QUEENSLAND OAKS - 2400m
1st – Miss Keepsake 2nd – Marheta 3rd – Danaupair Starlet 4th – Absolute Joy
Trainer C. Waller was fined $200 under LR. 70 for failing to declare J. Cassidy as the rider of AL NAKHLA by the prescribed time.
Connections advised that FAIRY OAK will be ridden more positively if circumstances permit.
The declaration of correct weight was delayed as the stewards were concerned that DARIANA (S. Arnold), which remained in the stalls after the start, may have been denied a fair start. Before forming an opinion in relation to this matter, evidence was taken from Mr W. Shuck, the head starter, also from rider S. Arnold and Mr Reg Fleming, stable representative for trainer B. Cummings. Subsequent to this, the stewards were of the view that when the gates opened DARIANA, although slightly sideways on, had the opportunity to jump but turned its head to the left-hand side and was then caught behind the partition on the outside of its starting gate and as a consequence could not come out. Therefore it was decided that the provisions of AR. 134A not be enforced and DARIANA was officially declared to be a runner and correct weight was then declared on the numbers as provided by the Judge.
On jumping AMBITIOUS PRINCESS (D. Oliver) was checked when crowded for room between BITASILK (J. Taylor) and CAISEAL (D. Nikolic), both of which shifted ground abruptly.
AL NAKHLA (J. Cassidy) was tightened for room on jumping away between CASSINI CONTEST (H. Bowman), which shifted out, and FAIRY OAK (L. Nolen), which was taken in by C’MON CUBA (L. Nolen).
Near the 1900m STATUS QUO (K. McEvoy) shifted in tightening the running of CAISEAL and BITASILK.
Leaving the 1900m MISS KEEPSAKE (C. Munce) had to be steadied from the heels of C’MON CUBA which shifted in.
Approaching the 1800m UTOPIA (J. Byrne) had to be steadied off the heels of MARHETA (M. Zahra), which was taken in by DANAUPAIR STARLET (M. Cahill).
STATUS QUO, MARHETA, CASSINI CONTEST and AL NAKHLA raced wide throughout.
Approaching the 400m SPERA (D. Browne) shifted out and made contact with C’MON CUBA, which in turn shifted out and bumped STATUS QUO.
M. Cahill, the rider of DANAUPAIR STARLET, was found guilty of a charge of careless riding under AR. 137(a) in that near the 400m he allowed his mount to shift out when not sufficiently clear of FAIRY OAK (L. Nolen), resulting in FAIRY OAK having to be checked to avoid the heels of DANAUPAIR STARLET. M. Cahill’s licence to ride in races was suspended for a period of 8 meetings, with the term of suspension to commence following the expiration of an existing term of suspension, and expire at midnight on Wednesday, 30 June 2010. AMBITIOUS PRINCESS, which was following was also forced to check in this incident.
An inquiry into the reason for DRIVEL having to be checked near the 300m was adjourned to a time and date to be fixed. Stewards will interview T.Angland regarding the reason for him leaving the course without permission.
Near the 200m BITASILK had to be steadied when tightened for room between STATUS QUO, which shifted out, and C’MON CUBA, which shifted in under pressure.
J. Cassidy, the rider of AL NAKHLA, was found guilty of a charge of careless riding under AR. 137(a) in that near the 200m he permitted his mount to shift in when insufficiently clear of CASSINI CONTEST (H. Bowman), resulting in that horse being tightened for room between AL NAKHLA and AMBITIOUS PRINCESS, losing its rightful running and having to be steadied. J. Cassidy’s licence to ride in races was suspended for a period of 7 meetings, with the term of suspension to commence at midnight on Saturday, 12 June, and expire at midnight on Wednesday, 23 June 2010.
An inquiry was adjourned into the reason for AMBITIOUS PRINCESS and AL NAKHLA being tightened for room leaving the 200m.
Race 8: TCL ELECTRONICS QTC CUP - 1300m
1st – Catapulted 2nd – Border Rebel 3rd – Ego’s Dare 4th – Graceful Anna
Stewards considered an objection lodged by apprentice T. Bell, the rider of BORDER REBEL, which finished 2nd, against CATAPULTED (D. Oliver) being declared the winner, alleging interference to BORDER REBEL at about the 400m. Evidence was taken from all parties concerned and the stewards formed the opinion that near the 400m BORDER REBEL had established a run outside CATAPULTED but had to be checked when CATAPULTED shifted out to improve. However, stewards could not be satisfied to the required standard that the interference suffered by BORDER REBEL was sufficient to establish that it could have finished in front of CATAPULTED and therefore the protest was dismissed and correct weight was declared on the Judge’s placings. At a subsequent inquiry, D. Oliver, the rider of CATAPULTED, was found guilty of a charge of careless riding under AR. 137(a) in that leaving the 400m he permitted his mount to shift out when insufficiently clear of BORDER REBEL, resulting in that horse losing the running to which it was rightfully entitled. D. Oliver’s licence to ride in races was suspended for a period of 7 meetings, with the term of suspension to commence at midnight on Saturday, 12 June, and expire at midnight on Wednesday, 23 June 2010.
THE JACKAL (R. Thompson) was slow to begin.
Shortly after the start MR SLICK (B. El-Issa) lost its position when tightened for room between BORDER REBEL and DRENALIN (B. Stewart), which was taken in by GRACEFUL ANNA (L. Cassidy).
Passing the 1100m DRENALIN and MR SLICK were forced to race in restricted room to the inside of GRACEFUL ANNA which shifted in.
STRYKER (J. Cassidy), FRITZY BOY (C. Munce) and MR BARITONE (M. Zahra) raced wide throughout.
Leaving the 300m GRACEFUL ANNA had to be steadied when tightened for room between FRITZY BOY and DRENALIN which shifted out slightly.
Approaching the 100m BORDER REBEL was disappointed for a run between CATAPULTED and STRYKER and was obliged to alter course to the inside of CATAPULTED to obtain clear running.
AHDASHIM (B. Shinn) lost its near fore plate in running.
A post-race veterinary examination of PLAIN MAGIC (J. Byrne) revealed no significant abnormalities.
