RACE 6: Class 2 Handicap 1050 Metres - 9 Starters
WESTERN JET (C Rodgers) jumped out at the start and made contact with ELUSIVE DIAMOND (M Goodwin).
On return to scale a protest was lodged by M Goodwin rider of the second placegetter ELUSIVE DIAMOND against WORTHY PRINCE (D Simmons) being declared the winner alleging interference at the 400 metres and again at the 100 metres.
After taking evidence from all parties and viewing the stewards patrol footage, it was established that upon straightening ELUSIVE DIAMOND was unable to consolidate a run which had presented itself momentarily to the inside of WORTHY PRINCE and therefore lost no ground. It was also established that leaving the 150 metres ELUSIVE DIAMOND when attempting a run to the inside of WORTHY PRINCE shifted out and had to be steadied of that horses heels. Shortly after WORTHY PRINCE shifted in resulting in ELUSIVE DIAMOND having to again be restrained to avoid that horses heels. Stewards were of the opinion that the interference suffered by ELUSIVE DIAMOND as a result of WORTHY PRINCE shifting in near the 100 metres was not sufficient to warrant a reversal of the placing’s and therefore dismissed the objection and declared correct weight on the numbers semaphored.
D Simmons rider of WORTHY PRINCE was found guilty of a charge of careless riding under AR137(a) in that as the rider of WORTHY PRINCE he did allow that gelding to shift in near the 100 metres when not clear of ELUSIVE DIAMOND (M Goodwin) resulting in that horse having to be restrained to avoid the heels of WORTHY PRINCE. As a result WESTERN JET (C Rodgers) which was following struck the heels of ELUSIVE DIAMOND (M Goodwin)and blundered. Jockey D Simmons license to ride in races was suspended for a period covered by 2 North Queensland meetings to commence at midnight Tuesday the 28th of September up to and including Tuesday 5th of October 2004.
All winners were sent to be swabbed.
