SUPPLEMENTARY REPORT

From, Doomben, 19.5.12 – Doomben Cup

Stewards had immediate concerns with what appeared to be inconsistent evidence provided by jockey L. Nolen in a hearing conducted following a protest lodged by the trainer of Manighar, Mr Peter Moody, and a subsequent stewards’ inquiry into interference suffered to that runner. As jockey Luke Nolen had an engagement in Toowoomba, the matter could not be completed on Saturday the 19th. After taking further evidence from L. Nolen, he was found guilty of a charge under the provisions of AR175(gg) in that he provided misleading evidence to the stewards in an inquiry into interference sustained by MANIGHAR after passing the winning post on the first occasion, subsequent to evidence he provided in a protest hearing immediately after the race. L. Nolen was fined the sum of $2000. When assessing penalty, stewards took into account the status of the race, also L. Nolen’s race riding experience at the highest level and his standing in the industry.

Race 1: Oztronics Class 6 H'cap – 1615m
1st – Shezahotshot 2nd – Ausworld 3rd – Lovingthelimelight 4th - Freton

As L. Nolen was to be overweight, J. Ford was substituted as the rider of CYCLONE AL. As L. Nolen informed stewards immediately following rider declaration on Wednesday, a reprimand was imposed.

Trainer J. Morrisey was fined $200 for failing to declare a rider for HOROSCOPES by the prescribed time.

On return to scale, a protest was lodged by B. Stewart, rider of the 2nd placegetter AUSWORLD, against SHEZAHOTSHOT being declared the winner, alleging interference near the 450m. After taking evidence from the relevant parties and viewing the available footage, stewards found that B. Stewart did have to restrain AUSWORLD near the 450m when tightened for room between SHEZAHOTSHOT (G. Cooksley) and LOVINGTHELIMELIGHT (J. Byrne), which shifted out around the heels of HOROSCOPES (L. Cassidy). As stewards could not be satisfied that the interference sustained by AUSWORLD could be attributed to SHEZAHOTSHOT, the protest was dismissed and correct weight was semaphored on the Judge’s placings. At a subsequent inquiry, J. Byrne, rider of LOVINGTHELIMELIGHT, was found guilty of a charge of careless riding, that near the 450m he permitted his mount to shift out to a position outside the heels of HOROSCOPES (L. Cassidy) when insufficiently clear of AUSWORLD, resulting in AUSWORLD being tightened between LOVINGTHELIMELIGHT and SHEZAHOTSHOT and losing its rightful running. Stewards were of the opinion that SHEZAHOTSHOT did shift in slightly in this incident when hanging in. J. Byrne was suspended from riding in races for a period covered by 7 meetings with suspensions incurred at a later stage of this race and in Race 4.

RUN JAKE RUN (S. Drake) was slow to begin.

THEY WON’T LAST (J. Lloyd) raced fiercely in the early stages. As a result of this, THEY WON’T LAST shifted out making the first turn. THEY WON’T LAST continued to overrace in the middle stages.

SAVAGE RIVER (T. Bell), CYCLONE AL (J. Ford) and RED GOD (M. Cahill) were unable to secure clear running in the home straight and as result went to the line not being fully tested by the relevant riders.

J. Byrne, rider of LOVINGTHELIMELIGHT, pleaded guilty to a charge of careless riding, in that over the concluding stages he permitted his mount to shift in under riding when insufficiently clear of FRETON, resulting in that horse being taken in onto THEY WON’T LAST (J. Lloyd) and PLAYACTION (J. Taylor), resulting in both of these runners being tightened for room and PLAYACTION having to be checked. J. Byrne was suspended from riding in races for a period covered by 7 meetings, also to be served concurrently with suspensions incurred earlier in this race and in race 4.

Near the 300m, EASTLINE (J. Adams) shifted out and brushed AUSWORLD.

FRETON (C. Munce) had difficulty obtaining clear running rounding the home turn and in the home straight until nearing the 200m.

THEY WON’T LAST had difficulty securing clear running in the home straight until near the 100m.

SHEZAHOTSHOT (G. Cooksley) hung in when placed under pressure in the home straight, and near the 250m shifted in and inconvenienced HOROSCOPES (L. Cassidy).

HOROSCOPES, CYCLONE AL and RED GOD raced 3 wide throughout.
B. Stewart, rider of AUSWORLD, was fined $100 for using his whip more than 5 times prior to the 100m.

Race 2: Ambassador Travel QTIS 3yo H'cap - 1200m

CHUBBY CHIPMUNK (M. Hellyer) was slow to begin.

RETSINA (K. McEvoy) shifted in at the start and bumped VIKING HEART (C. Munce).

Shortly after the start, DIVINE CITY (A. Allen) was tightened for room between IN A STORM (J. Byrne), which shifted out away from LUCKY TYCOON (G. Cooksley), and LONGSHOREMAN (S. Galloway), which shifted in.

Approaching the 600m, IN A STORM (J. Byrne), when overracing, improved to the inside of LUCKY TYCOON (G. Cooksley) where there was insufficient room and had to be checked.

STRADON (R. Wiggins) overraced in the early stages and approaching the 800m improved onto the heels of LONGSHOREMAN (S. Galloway) and had to be steadied. As a result, VIKING HEART (C. Munce), which was following and also overracing, had to be checked to avoid the heels of STRADON.

Approaching the 800m, LONGSHOREMAN (S. Galloway) had to be eased when tightened for room by STAGE EXIT (J. Lloyd), which shifted in away from VOLKHERE despite the efforts of its rider.

Near the 400m, STRADON (R. Wiggins) had to be steadied when tightened for room between LONGSHOREMAN (S. Galloway), which shifted out slightly, and RETSINA (K. McEvoy), which shifted in.

DIVINE CITY (A. Allen) and VIKING HEART were held up for clear running rounding the home turn and in the home straight until approaching the 200m.

R. Wiggins, rider of STRADON, pleaded guilty to a charge of careless riding, in that approaching the 200m he permitted his mount to shift in when insufficiently clear of LONGSHOREMAN, resulting in jockey S. Galloway having to take hold of LONGSHOREMAN. LONGSHOREMAN then faltered after becoming unbalanced. R. Wiggins was suspended from riding in races for a period covered by 7 meetings, to commence at midnight, 2 June and to expire at midnight, 12 June.

Near the 200m, VIKING HEART shifted out and made heavy contact with the hind quarters of LOSE IT (M. Cahill), resulting in both runners becoming unbalanced. C. Munce, rider of VIKING HEART, was advised to ensure that he has sufficient racing room to improve his position in the future.

RETSINA and CHUBBY CHIPMUNK raced wide throughout.

Race 3: Sita Austarlia The Phoenix – 1350m
1st – Boban 2nd – Hoss Amor 3rd – Regular 4th - Caliente

FATHOM (M. Cahill) overraced in the early stages.

Approaching the 1000m, CALIENTE (L. Cassidy), when overracing, had to be steadied from the heels of HOLEY GADOLEY (G. Cooksley). COURTZ BOY (J. Byrne), which was following, also had to be steadied and shifted out, hampering FATHOM (M. Cahill).

Passing the 600m, SATURN ROCK (C. Munce) had to be steadied from the heels of CALIENTE (L. Cassidy), which shifted in slightly.

Rounding the home turn, BOBAN was held up when unable to secure clear running.

Near the 350m, HOSS AMOR (J. McDonald) was disappointed for a run between NEVER DESPAIR (L. Nolen) and REGULAR (D. Griffin). HOSS AMOR then shifted to the inside of the heels of NEVER DESPAIR (L. Nolen) in order to improve.

REGULAR (D. Griffin), WILL BE AMAZED (J. Lloyd), TOP RADA (E. Wilkinson) and HI SON (T. Bell) raced wide throughout.

G. Cooksley reported that HOLEY GADOLEY shifted out abruptly rounding the home turn. As a result of this, NEVER DESPAIR and REGULAR were taken wider on the track, and HOSS AMOR (J. McDonald), which was trailing, HOLEY GADOLEY, had to shift wider on the track to avoid that runner’s heels. Trainer P. Duff was advised that a warning would be placed on HOLEY GADOLEY regarding its racing manners.

Race 4: Ticketek Class 6 Plate – 1350m
1st – Raise Up 2nd – My Quilter 3rd – Dusty Gold 4th – Demanding Miss

STARSTREAMED (C. Brown) was slow to begin.

EMVOSS (J. McDonald) jumped away awkwardly and shifted out, brushing RAISE UKP (K. McEvoy).

HOUR OF PERIL (J. Cassidy) was inclined to lay out when overracing in the early stages.

Near the 900m, EMVOSS, when overracing fiercely, had to be checked from the heels of KISS ME DEADLY (T. Bell). As a result of this, EMVOSS, shifted out, taking CAPTAIN CLAYTON (J. Byrne) wider on the track and CRYON (L. Cassidy), which was following, was also inconvenienced.

J. Byrne, rider of CAPTAIN CLAYTON, was found guilty of a charge of careless riding, in that near the 200m he permitted his mount to shift out, resulting in HOUR OF PERIL (J. Cassidy) having to be checked when tightened for room between CAPTAIN CLAYTON and DARTH (S. Drake), which was also taken in slightly by EMVOSS. J. Byrne was suspended from riding in races for a period covered by 8 meetings, to be served concurrently with the 2 careless riding suspensions incurred in Race 1, and to commence at midnight, 26 May, and to expire at midnight, 9 June.

Passing the 200m, DUSTY GOLD (M. Vance) shifted out under pressure, taking GREY ASSIGNMENT (C. Munce) out on to STARSTREAMED (C. Brown), resulting in those runners bumping on a number of occasions. M. Vance, rider of DUSTY GOLD, was advised to make greater efforts to stop riding and straighten her mounts in similar circumstances.

Stewards sought an explanation from J. McDonald regarding the performance of EMVOSS. Jockey . McDonald explained EMVOSS overraced badly in the early and middle stages and on a number of occasions had to be restrained from the heels of KISS ME DEADLY (T. Bell). He was of the opinion that EMVOSS was unable to sprint as expected as a result of it overracing for a major part of the race. J. McDonald added that the racing manners of EMVOSS affected the capacity of the gelding to finish the race off.

Race 5: Mullins Lawyers Grand Prix Stakes - 2200
1st – Brambles 2nd – Vatuvei 3rd – Red Shift 4th - Soros

SOROS (V. Duric) and ISOPACH (J. Lloyd) were slow to begin.

ST SULLY (J. Byrne) and COLOUR ME GRAND raced 3 wide in the early and middle stages until a point near the 1000m.

Trainer M. Thexton reported she was of the opinion that PRECIOUS MANDY got its tongue over the bit and chocked down and that was the reason for the filly compounding from the 600m. M. Thexton advised she would add a tongue-tie to the gear of PRECIOUS MANDY for future starts.

Near the 600m, PRECIOUS MANDY (G. Cooksley), when weakening, shifted in away from DURNFORD (R. McLeod), resulting in VATUVEI (L. Nolen) having to be steadied.

McDonald was suspended from riding in races for a period covered by 10 meetings, to commence at midnight, 2 June and to expire at midnight, 16 June.
