On return to scale a protest was lodged by J. Byrne, rider of the 5th placegetter, NOVA STAR, against BENEDETTI being declared the 3rd placegetter, alleging interference near the 200m. After taking evidence from the parties concerned and viewing the video, stewards believed that the interference to NOVA STAR was as a result of brushing near the 200m and was not sufficient to amend the Judge’s placings. The protest was therefore dismissed.
GEE I JANE (M. Rodd), ROYAL IDA (D. Dunn), REIGNING TO WIN (G. Boss) and SNORT (B. El-Issa) were all slow to begin.
THE JACKAL (A. Pattillo) jumped awkwardly, almost dislodging its rider.

Approaching the 800m, NOVA STAR (J. Byrne), which was overracing, had to be steadied off the heels of MR UBIQUITOUS (S. Seamer).
Stewards adjourned an inquiry into the reason for SHINZIG having to be checked near the 700m. After taking evidence from J. Taylor (MAGIC MARVO) AND G. Boss (REIGNING TO WIN), the inquiry was adjourned to a date to be fixed to enable G. Childs to be present.
Near the 200m, BENEDETTI (S. King) shifted in and brushed NOVA STAR (J. Byrne).
BLACK INK, ROYAL IDA and MAGIC MARVO raced wide throughout.
A post race veterinary examination of XCELLENT and MITANNI failed to reveal any abnormalities.

Race 7: BMW Queensland Derby – 2400m
1st – Empires Choice 2nd – Volcanic Star 3rd – Sirmione 4th – Resolution
SIRMIONE was examined by the club’s veterinary surgeon at the barriers and was cleared to race.
On return to scale a protest was lodged by S. Arnold, rider of the 2nd placegetter, VOLCANIC STAR, against EMPIRES CHOICE being declared the winner, alleging interference over the final 100m. After taking evidence from the parties concerned and viewing the film, stewards established that although EMPIRES CHOICE did shift out over the concluding stages taking VOLCANIC STAR a number of horses wider, stewards could not be comfortably satisfied that had the impediment to VOLCANIC STAR not occurred that horse would have beaten EMPIRES CHOICE and therefore the protest was dismissed.
RESOLUTION (M. Coleman) jumped awkwardly.
READY WHEN YOU ARE (J. Sheehan) was tightened on jumping away between SOPHISTICATION (D. Beadman) and CURRIGEE (S. Katsidis), which shifted out.
Approaching the winning post on the first occasion, SARATIME (N. Ryan) was tightened for room between MY CENTURION (J. Holder) and DANZIBAA (K. Forrester), which shifted out slightly.

Stewards opened an inquiry into the reason for G. Childs being dislodged from ESKIMO QUEEN near the 1500m. After taking evidence from C. Williams, rider of SANDS OF TIME, G. Boss, rider of FUJI FANTASY and FORT ‘N’ WON (B. Stewart), the inquiry was adjourned to a date to be fixed to enable G. Childs, who was injured and taken to hospital, to be present. DANZIBAA and MY CENTURION, which were following, were hampered to varying degrees to avoid the fallen rider.
S. Scriven, rider of TAKE THE PLEA, was found guilty of a charge of careless riding, in that near the 600m he shifted to the outside of SANDS OF TIME in an endeavour to obtain a run between that horse and FUJI FANTASY, and as a result FUJI FANTASY was tightened for room between DANZIBAA and TAKE THE PLEA and had to be checked. S. Scriven was suspended from riding in races for a period covered by 9 meetings, to commence at midnight, 13 June, and to expire at midnight, 30 June 2007. S. Scriven was also fined the sum of $1000.

A post race veterinary examination of SANDS OF TIME revealed the gelding to be suffering form cardiac arrhythmia. Trainer P. Duncan was advised that he must provide to the stewards a veterinary clearance, including the results of an ECG, and that the gelding must trial satisfactorily prior to its next race start.
The club’s veterinary surgeon also reported that ESKIMO QUEEN had sustained lacerations under the jaw and near fore pastern.
J. Sheehan, rider of the READY WHEN YOU ARE, was fined $200 for returning to scale in excess of half a kilogram overweight. AR145
Race 8: Myer QTC Lightning H’cap - 1000m
1st – Sequallan 2nd – Sectagonal 3rd – Words Of Magic 4th – Sir Monashee
Stewards adjourned an inquiry into the reason for SIR MONASHEE being presented to the enclosure without pacifiers which were part of its approved gear.
SHOW BIZ KID, which was kicked at the barriers and sustained multiple lacerations and bruising to the off hock, was declared a late scratching at 4.45 pm on veterinary advice. Subsequent to the event all monies invested on SHOW BIZ KID were ordered to be refunded, with deductions of 3 cents in the dollar on the face value of win and place bets applicable.
Stewards considered an application from jockey S. Katsidis, rider of ENTHUSIAST, being denied a fair start. After taking evidence from S. Katsidis and viewing the film, stewards were satisfied that ENTHUSIAST was afforded a fair start and therefore ENTHUSIAST was declared a starter and correct weight was given.
WORDS OF MAGIC and HASTA LA CIAO CIAO were slow to begin.
Shortly after the start, BISCAYNE BAY commenced to lay in and did so for the remainder of the event.
Passing the 800m, ENTHUSIAST commenced to overrace and did so for some distance.
