Jockey A. Pattillo was found guilty of a charge under AR85B, in that he failed to fulfil 6 engagements at the above race meeting and was fined $300.

From BTC, 16 September 2009 – Race 3.

Stewards sought an explanation from jockey J. Byrne, rider of DRAWN TO DUBAI, in regard to his failure to ride his mount right out to the finish line. J. Byrne stated that the horse had a tendency to hang out and this resulted him being unable to ride the horse to the finish line in his customary manner. Stewards accepted jockey Byrne’s explanation.


Race 1: Blacks Trucks Class 6 Plate – 2136m
1st –Crossthestart 2nd – Beartracker 3rd – Uncle Jan 4th - Eureka

JEDI STARFIGHTER (M. Cahill) overraced when racing wide in the early stages.

Near the 1300m, STRAWBERRY RIPPLE (M. Hellyer), which was overracing at the heels of ESTRELLITO (S. Katsidis), shifted out, taking CROSSTHESTART (J. Byrne) 3 wide. J. Byrne, rider of CROSSTHESTART, was then obliged to allow his mount to improve forward to a position outside the leader. STRAWBERRY RIPPLE continued to overrace for some distance thereafter.

An inquiry was opened into the reason for apprentice M. Hellyer being dislodged from STRAWBERRY RIPPLE near the 400m. After taking initial evidence from S. Katsidis, rider of ESTRELLITO, M. Cahill, rider of JEDI STARFIGHTER and S. Seamer, rider of CORAL FLIGHT, the inquiry was adjourned to a date to be fixed. As a result of this incident, some inconvenience was caused to JEDI STARFIGHTER, and CORAL FLIGHT (S. Seamer), which was following, was checked and shifted ground. M. Hellyer was unable to fulfil his remaining engagements and riding changes were made as per the Stewards Summary Sheet.

After passing the 200m, TORA SAND was inconvenienced by the riderless STRAWBERRY RIPPLE.


Race 2: Jaspa Engineering 1MW H'cap - 1200m
1st – Blackwoods Choice 2nd – Ulladulla 3rd – Guissepino 4th - Samtheflirt

The starting time for this race was rescheduled to 1.27 pm to allow for the arrival of a second ambulance.

GUISSEPINO (M. Speers) was slow to begin.

Approaching the first turn, GUISSEPINO (M. Speers) commenced to overrace and had to be steadied from the heels of FANTASTIC MOVIE (L. Cassidy). GUISSEPINO then continued to overrace until near the 600m.

Nearing the 200m, BLACKWOODS CHOICE (J. Byrne) was disappointed for a run between PELLTRO (D. Browne) and GUISSEPINO, which was laying in, J. Byrne, rider of BLACKWOODS CHOICE, was obliged to shift ground around the heels of GUISSEPINO to obtain clear running. GUISSEPINO continued to lay in for the remainder of the event.

SAMTHEFLIRT (M. Cahill) hung in in the straight, placing its rider at a disadvantage. Trainer G. Kirkup was advised that should the gelding perform similarly again, action may be taken against it.


Race 3: CMA Recycling QTIS 3yo H'cap - 1500m
1st – Titanium Rock 2nd – African Lion 3rd – Listen Son 4th – Shadows ‘N’ Star

In the middle stages, SHADOWS ‘N’ STAR (S. Seamer) overraced at the heels of ARCUP (C. McIver).


Race 4: Driver Recruitment NMW H'cap – 1830m
1st – Outer Pole 2nd – Just A Classic 3rd – Yield Curve 4th – three Tenors

Trainer B. Dodson was fined $100 for failing to present the Document of Description for OUTER POLE.

THE CAVERN CLUB (C. McIver) jumped away awkwardly and lost ground.

Approaching the first turn, THE CAVERN CLUB commenced to overrace and shifted out, taking THREE TENORS (S. Apthorpe) wider on the track. THE CAVERN CLUB then continued to overrace obliging its rider to improve forward to the leading position.

THREE TENORS (S. Apthorpe) raced wide throughout.

Jockey C. McIver, rider of THE CAVERN CLUB, explained that he had been told by trainer B. Miller if the horse jumped to try and take up a position somewhere towards the front but with cover, however if THE CAVERN CLUB happened to miss the start, he was to take up a position somewhere towards the middle but again with cover. He added that THE CAVERN CLUB reared on 2 occasions before the gates opened and just as they opened was beginning to rear again and therefore missed the start. He further stated that he endeavoured to find a position somewhere towards the middle of the field but THE CAVERN CLUB proved very difficult for him to manage and he was unable to find any cover and had to go forward. He said he tried to find a position behind PARALEGAL but was unable to do so, and he considered, in the circumstances, he had no alternative but to allow THE CAVERN CLUB to stride to the front.

L. Rolls, rider of THIN AND CRISPY, explained that in the early part of the straight he was awkwardly placed between PARALEGAL (M. Speers) and THE CAVERN CLUB (C. McIver) where he had hoped to obtain running, however this did not eventuate and had to shift out in an endeavour to go forward. He further stated that he did obtain running however THIN AND CRISPY did not close off the race as he thought it would.


Race 5: Kartaway Miniskips CG&E Class 6 H'cap – 1400m
1st – Mr Orient 2nd – Thorondo 3rd – Tears’n’cheers 4th – Sir Kingsford

ENCOSTA TSZYU (R. Wiggins) and SIR KINGSFORD (D. Browne) were slow to begin.

G. Colless, rider of TEARS’N’CHEEERS, pleaded guilty to a charge of careless riding, in that approaching the 1200m he permitted his mount to shift in when not sufficiently clear of SIR KINGSFORD (D. Browne), resulting in SIR KINGSFORD having to be checked. G. Colless was suspended from riding in races for a period covered by 7 meetings, to commence at midnight, 20 September and to expire at midnight, 3 October 2009. At the conclusion of this inquiry, D. Brown (SIR KINGSFORD) was told he must endeavour to give straight-forward evidence at inquiries being conducted by Queensland Racing Stewards.

Jockey D. Browne (SIR KINGSFORD) was reminded of his obligations to ride all of his mounts out at least hands and heels right to the finish post whenever possible.

A post race veterinary examination of ROCKARIA revealed the gelding to be sore in the near hind leg. Trainer J. Fitzgerald was advised he must provide a veterinary clearance for ROCKARIA prior to its next race start.

A post race veterinary examination of AT MY COMMAND revealed the gelding to be sore in the off fore fetlock. Trainer L. Birchley was advised that he would be required to provide a veterinary clearance for the horse prior to its next race start.


Race 6:SITA Recycling Open H'cap - 1600m
1st –Secrets Untold 2nd – Sneaky Long 3rd – Kentish 4th – Future’s Dream

Near the 1400m, SNOW DESTINY (S. Seamer) commenced to overrace and had to be steadied from the heels of SECRETS UNTOLD (M. Hughes). SNOW DESTINY continued to overrace in the middle stages of the event.

Passing the 1000m, FUTURE’S DREAM (L. Cassidy), which was occupying an unorthodox position back and to the outside of the leader, shifted out slightly and made contact with KENTISH ROSE (S. Katsidis), which was endeavouring to take up a position one off the fence to his outside of the leader. S. Katsidis then applied pressure to FUTURE’S DREAM, resulting in FUTURE’S DREAM, being forced inwards behind the leader SNEAKY LONG. Stewards, after considering the evidence provided, issued a severe reprimand to both riders.

Leaving the 200m, SECRETS UNTOLD (M. Hughes), when endeavouring to obtain clear running, shifted out and made contact with KENTISH ROSE (S. Katsidis).


Race 7: SITA Environmental F&M H'cap - 1400m
1st – Pertinence 2nd – Plenty Of Practise 3rd – Sheeza Drama 4th – Lilleelavee

In the early and middle stages, USED TO BE A DANCER (P. Hammersley) overraced and pulled hard, proving difficult to ride.

When questioned, L. Rolls, rider of FASLIYEV DANCER, stated that he had been given instructions by trainer T. Bailey this morning and he was told to be positive early and take up a forward position and then try to steady the horse. He stated that in accordance with these instructions he rode his mount along just after the start and took up the lead and that FASLIVEV DANCER was travelling well in front but he was concerned that it might have been going to hard in the quality of today’s race and he endeavoured to settled his mount. He acknowledged that in hindsight this was an error from him, and given the opportunity to ride the race again he would allow FASLIYEV DANCER to continue to stride along. No direct action was taken, however stewards advised apprentice Rolls that the manner in which he rode FASLIVEV DANCER had caused concern and if he found himself in a similar circumstance in future they would expect he would display greater judgement.


Race 8: Superior Pak Open H'cap - 1200m
1st – Rasmussen 2nd – Southerly Impact 3rd – Eleda 4th – My First Affair/Nepro

In the early part of the straight, VOCALIC (P. Wolfgram) was held up for clear running, and after the 200m had to shift in abruptly to obtain clear running.

NEPRO (C. McIver), DAEDALUS (L. Cassidy), ART SUCCESS (M. Hughes) raced 3 deep throughout.
