RACE 4: STANLEY HOTEL CLASS 1 H’CAP – 1060M

On return to scale a protest was lodged by T. Williams, rider of the 4th placegetter, Kappytain, against Earlstoun Ruler being declared 1st and Solo Soprano being declared 2nd, alleging interference over the concluding stages.

After hearing submissions and viewing the patrol footage, stewards found that Solo Soprano shifted out under hard riding, making heavy contact with Kappytain, which when tightened onto the hind quarters of Earlstoun Ruler had to be checked. Stewards were therefore not satisfied that Earlstoun Ruler had shifted ground and dismissed this objection, however stewards were satisfied that the interference could be directly attributed to Solo Soprano shifting out and bearing in mind the margin between both horses at the finish, and the degree of interference suffered by Kappytain warranted a reversal of placings, and therefore the protest was upheld and the Judge’s placings altered to read:

No. 8 – Earlstoun Ruler – 1st No. 4 – Hysterical Miss – 2nd No. 6 - Kappytain – 3rd
No. 2 – Solo Soprano – 4th

Subsequent to the protest hearing, App. Jockey J. Greacen pleaded guilty to a charge of careless riding and was suspended from riding in races for a period covered by 7 meetings, to commence at midnight, 5 October and to expire at midnight, 17 October.
