Trainer L. Kiernan was fined $50 for failing to declare D Whitmore as the rider of MIDNIGHT SURRENDER, by the prescribed time.
Prior to correct weight being declared Jockey D Gill & Apprentice C Pye made application to the Stewards to be declared non-runners as both were of the opinion the barriers had failed to open properly and also slow to open. After taking evidence from the riders and Trainer A Stephens stewards sought Jockey D Whitmore’s opinion in regards to MIDNIGHT SURRENDER and subsequently made an application to be declared a non runner. It was established that the barriers of MAKE A DEAL, WINCHMORE LASS, and MIDNIGHT SURRENDER had failed to open and or had been slow to open when the start was effected and these runners had been denied the opportunity to begin in the field and therefore denied a fair start.
All monies invested on MAKE A DEAL, WINCHMORE LASS and MIDNIGHT SURRENDER were ordered to be refunded. Deductions applicable to bets placed on the winner and place-getters.:-

ELLE DANSAIT was subsequently vetted. The Veterinary officer found no abnormalities.
Trainer D Johnston advised that the mare would be given a short let up for two weeks immediately and that he would get the mare examined by his vet and notify stewards. Trainer D Johnston reported to stewards that ELLE DANSAIT had undergone a caslick operation which he believes may have contributed to the mares’ poor performance. On the basis that Jockey Bannon was of the belief that the mare was sore and given its performance ELLE DANSAIT will be required to pass a barrier jump out of at least 800m in front of a steward and a Veterinary certificate of fitness must be furnished prior to next start.
