GENERAL:

Stewards considered a written complaint lodged by Licensed Trainer Mr W. Clark regarding the riding of PRINCE KARION and CITY OF SMILES, by M. Dale and P. Cullen respectively in Races 2 and 3 at the Charters Towers meeting on Sunday 31st July 2005. In the course of the inquiry into the complaint stewards took evidence from Mr Clark, Jockeys M. Dale, P. Cullen and M. Cullen and viewed the patrol films of the two races the subject of the complaint. After considering all of the evidence stewards found in respect of M. Dale’s riding of PRINCE KARION that there was no evidence to suggest that there had been a breach of the Rules of Racing. They further found that PRINCE KARION began awkwardly and there was no evidence to support Mr Clark’s claim that M. Dale had restrained the horse to prevent it from beginning fairly. In respect of Mr Clark’s complaint about P. Cullen’s riding of CITY OF SMILES, stewards found that the video film of the race was inconclusive and did not enable them to establish beyond a reasonable doubt that CITY OF SMILES was not ridden out fully to the finish by P. Cullen. The accepted that the finishing positions of the placegetters would not have changed had P. Cullen ridden the horse to the finish under full whip riding. Nevertheless they reminded P. Cullen of his obligation to ride his mounts out, at least hands and heels, right to the finish.

LATE RIDING CHANGES

As M. Elliott was indisposed the following substitutions were made: Race 3, G. Cullen to ride BEST WAY; Race 6, F. Edwards to ride STRICTLY SMART.

Race 1: Smirnoff Black Class 2 Handicap - 1000 metres
1st - ZEDOLLARS 2nd - PAYPACKET 3rd - SPEEDY AFFAIR 4th - SOLIDIFIED

As G. Kliese, the declared rider for SPEEDY AFFAIR, was to be overweight, J. Stopps was substituted. G. Kliese was fined $100 under A.R. 120(b).

PAYPACKET (J. P. Stanley) and SOLIDIFIED (G. Cullen) came together.

For some distance shortly after the start there was general tightening to runners on the outside of the field. When J. Stanley, the rider of PAYPACKET, shifted his mount out in an attempt to relieve the pressure, SOLIDIFIED (G. Cullen) was taken out onto GRASS CATCHER (J. Felix), which had to be restrained to avoid the heels of COOL ALLEY (D. Green).

Approaching the 900 metres SPEEDY AFFAIR (J. Stopps) was steadied away from the heels of MISS KINGARYN (F. Edwards).

At about the 400 metres MY SALADDIN (Apprentice R. Plumb) was unable to obtain clear running and had to be restrained and then at about the 300 metres was checked when disappointed for a narrow run to the inside of MISS KINGARYN (F. Edwards).

Approaching the home turn ZEDOLLARS (M. Bennett) was shifted out to improve and in doing so was restrained to avoid the heels of GRASS CATCHER (J. Felix).

Race 2: Ede’s Party Hire Class 6 Handicap - 1000 metres
1st - ESDENE’S SEQUEL 2nd - FINAL STORM 3rd - FRISKY ROSE 4th - RELOADED

FRISKY ROSE (D. Green) stood flat-footed at the start and lost ground.

When the start was effected GUNS ABLAZE (Apprentice R. Plumb) stood flat-footed and lost considerable ground. Trainer Mr E. Sewell was advised that the gelding was barred from competing at licensed meetings until it performs to the satisfaction of the stewards in a barrier jump-out.

At the entrance to the straight FRISKY ROSE (D. Green) was held up behind RELOADED (J. Felix) and unable to obtain clear running.

RELOADED (J. Felix) made the home awkwardly.

When questioned about the run of EXPRESS MESSENGER, Jockey G. Michaels explained that the gelding had been restless in the barriers and after beginning fairly was unable to muster early speed. He said that EXPRESS MESSENGER then hung in badly from the 700 metres, and in his opinion may not have handled the quick back-up following its performance at Mackay on Friday last.

Race 3: Yalumba Wines Maiden Handicap - 1000 metres
1st - EUSTON FLYER 2nd - WOOD DUX 3rd - L’UNICA DONNA 4th - VICTORY BEAU

Mr A. Bailey, representing trainer Mr S. Potiris, was advised that Mr Potiris was fined $50 under L.R. 42(2) for failing to lodge an amended stable return regarding the ownership of EUSTON FLYER.

On jumping A’SQUADRO (J. Felix) bounded in the air and lost ground.

WHO’S WHO (M. Cullen) began awkwardly.

BEST WAY (G. Cullen) was slow to begin.

Race 4: Mad Cow Tavern Fillies and Mares Class 2 Handicap - 1400 metres
1st - ANNIE LUCK 2nd - BONDS GIRL 3rd - EPONA’S BONUS 4th - RAINBOW DANCER

At the 900 metres BONDS GIRL (D. Evans) was steadied when disappointed for a run to the inside of OUR McGINTY (Apprentice R. Plumb).

Jockey F. Edwards was severely reprimanded for permitting BYE BYE DIAMONDS to shift in when insufficiently clear of OUR McGINTY (Apprentice R. Plumb), which had to be eased.

Race 5: XXXX Gold Class 5 Handicap - 1630 metres
1st - DINI WHO 2nd - MUMS THE WORD 3rd - DORIAN 4th - SKYWAYS

After arriving at the barriers RIGHT CONNECTION (J. Stopps) was examined by the Club’s veterinary surgeon. Acting on his advice that the gelding was unfit to start, stewards ordered the withdrawal of RIGHT CONNECTION at 3.01 p.m. Subsequently they ordered that all bets made on RIGHT CONNECTION be refunded in full and that all bets made with bookmakers prior to the withdrawal of RIGHT CONNECTION be paid less the following deductions in the dollar from the face value of successful tickets: win 4¢; place 5¢. Trainer Mr J. Dixon was advised that RIGHT CONNECTION was barred from competing at licensed meetings until a satisfactory certificate of veterinary fitness is furnished.

Near the 600 metres STEEL ‘N’ VET (M. Dale) and DORIAN (D. Crossland) came together.

In the early part of the straight DORIAN (D. Crossland) was disappointed for a run between DINI WHO (G. Michaels) and MUMS THE WORD (J. P. Stanley), and was shifted to the inside to obtain clear running.

D. Crossland (DORIAN) was reminded of his obligation to ride his mounts out, at least hands and heels, right to the finish.

After riding STEEL ‘N’ VET in this race Jockey M. Dale became indisposed and was unable to fulfil his further engagements.

Race 6: The Brewery Weight For Age - 1630 metres
1st - STRICTLY SMART 2nd - OVERSEAS 3rd - GALICANO 4th - STRIDERITE

Near the 1400 metres PLUMS (D. Evans), which was overracing, was eased to avoid the heels of GASNIER (Apprentice R. Plumb).

Approaching the 600 metres GALICANO (D. Crossland) was held up and unable to obtain clear running.

When questioned Jockey J. P. Stanley could offer no explanation for the poor performance of PAINTED UP. He said that the gelding travelled well early, but near the 1000 became awkward and hung out. He added that thereafter PAINTED UP failed to respond to his riding and he elected not to ride the horse out in the straight as he was of the opinion that it may have been sore in front. Race 7: Bank Lounge Bar QTIS Class 3 Handicap - 1200 metres
1st - TRIP TO MANILA 2nd - SEA COUNSEL 3rd - BEATTIE’S VICTORY 4th - SPECKLES

As M. Dale was indisposed J. Stopps was substituted as the rider of RED PYRAMID.

After arriving behind the barriers SEA COUNSEL broke free from a barrier attendant, but was quickly restrained.

When the start was effected RED PYRAMID (J. Stopps) shifted out and made contact with the hindquarters of GOLD TUSMANI (J. P. Stanley).

CROWN REGATTA (W. Kenning) began awkwardly.

When questioned about his riding of CROWN REGATTA, Jockey W. Kenning explained that after beginning awkwardly he rode his mount along in the early stages, but from the entrance to the straight CROWN REGATTA was a beaten horse and failed to respond to his riding, and therefore he eased the gelding down. W. Kenning was reminded of his obligation to ride his mounts out, at least hands and heels, right to the finish.

Race 8: Coyote Ugly Class 1 Handicap - 1200 metres
1st - BOLD SWEEPER 2nd - CHARLIE GUN 3rd - ROSIE’S BOY 4th - AULD FRIEND

As M. Dale was indisposed S. Watkin was substituted as the rider of POWER LION.

The start was delayed when CHARLIE GUN (D. Evans) proved difficult to load. Trainer Ms L. Manzelmann was advised to take the necessary measures to improve the horse’s barrier manners before presenting it to race again.

At the start TIME SWITCH (G. Kliese) shifted in and bumped DEARIE’S PRIDE (G. Cullen).

Rounding the turn at the 700 metres BOLD SWEEPER (J. P. Stanley) shifted out slightly and bumped SANLUCAR (M. Cullen), which in turn shifted out and hampered NORTHERN COMMANDER (J. Felix), which was hanging out.

Rounding the home turn CITY OF SMILES (D. Green) was held up and unable to obtain clear running.
