SUPPLEMENTARY REPORT:

Stewards today resumed an inquiry into the reason for Jockey P. Cullen being dislodged from HEDZ near the 900 metres in Race 5, the Ruddy, Tomlins & Baxter Class 6 Plate, 1300 metres, at the Townsville Turf Club meeting on 14th July 2009. At the initial hearing on the day in question evidence was taken from jockeys B. Pengelly, the rider of KHATAAF, W. Kenning, the rider of VISCOUNT GRAND, A. Pattillo, the rider of ETERNAL’S CHOICE, I. Fry, the rider of LESNER, G. Kliese, the rider of NAYNAY, and C. Eaton, the rider of BEEHIVES. Today evidence was taken from Jockey Cullen and further evidence was taken from Jockeys I. Fry, G. Kliese and W. Kenning, and the parties present viewed the official video films of the incident. In the opinion of the stewards, near the 900 metres HEDZ (P. Cullen), which was racing in restricted room, shifted out in an attempt to take a run where, in the opinion of the stewards, there was doubtful room to the inside of LESNER (I. Fry). As a consequence HEDZ blundered and fell, dislodging Jockey P. Cullen. As stewards could not be comfortably satisfied that any one rider was responsible for the incident, no action was taken.

Late Riding Changes:

When Apprentice J. Wood was indisposed, the following substitutions were made: Race 1, D. Green to ride SEA GOING (no apprentice rider available); Race 2, App. M. Hellyer to ride A L’AMOUR; Race 3, App. M. Hellyer to ride TARVOS; Race 5, Jockey T. Bannon to ride PERIQUE (no apprentice rider available); Race 6, Jockey T. Bannon to ride FLY TO WIN (no apprentice rider available); Race 8, to ride DEVI GARH.

Race 1: Aircrew Transfers Class 1 Handicap - 10400 metres
1st – TRUSTED PARTNER 2nd – SEA GOING 3rd – MALA MALA 4th – JAZZSHINKO

DIFFERENT DRUMMER (F. Edwards) began awkwardly.

NO MORE SHARES (D. Crossland) was slow to begin.

Shortly after the start DUCHENNE (G. Cullen) and WONKAVATOR (D. Simmons) were tightened for room between LOST IN LOUISVILLE (App. M. Hellyer) and TRUSTED PARTNER (A. Spinks), which shifted in.

Approaching the 500 metres PERUGIAN SPIRIT (W. Kenning) dipped.

Near the 500 metres ALBERTA LANE (C. Whiteley) shifted in of its own accord, made contact with the running rail, shifted out and bumped LOST IN LOUISVILLE (App. M. Hellyer).

Rounding the home turn JAZZSHINKO (J. Felix) and WONKAVATOR (D. Simmons) hung out.

When questioned regarding the performance of NO MORE SHARES, in particular settling back in the field, which was contrary to its previous start, Jockey D. Crossland explained that after being a little slow to begin, he elected to settle the horse back and gain cover as he was of the opinion that if he pushed forward he would have been caught wide, which would have been detrimental to the gelding’s performance. Jockey Crossland added that he settled further back than anticipated, but he was of the opinion that NO MORE SHARES found the line well. He said that in his opinion NO MORE SHARES will be better suited over longer distances than today’s event. His explanation was noted.

Race 2: Rawnsley Autos Maiden Handicap – 1000 metres
1st - CHEQUIN 2nd - NYMPHETTE 3rd – NEBO 4th – CHARACTER ASSASSIN

A L’AMOUR (App. M. Hellyer) began awkwardly and shifted out.

CHARACTER ASSASSIN (I. Fry) began awkwardly, shifted in and made contact with NEGO (G. Kliese).

In the middle stages CHARACTER ASSASSIN (I. Fry) commenced to over-race and passing the 600 metres the saddle on the gelding slipped, placing him at a disadvantage. Rounding the home turn CHARACTER ASSASSIN continued to over-race and was continually steadied off the heels of CHEQUIN (A. Spinks).

Race 3: Ozzie Camper QTIS 3-Y-O Handicap – 1200 metres
1st - MATSI CONCEPT 2nd - GENERAL WEILAND 3rd - SASSY ‘N’ BRASH 4th – CUGAT ANGEL

TARVOS (App. M. Hellyer) was slow to begin.

At the start BALAROOK (G. Kliese) and THECOAT (A. Spinks) were tightened for room between GENERAL WEILAND (D. Crossland) MATSI CONCEPT (B. Stewart), which shifted out.

GENERAL WEILAND (D. Crossland) over-raced early.

Near the 1100 metres HUSK’N’HEARTBREAK (S. Kaya), which was over-racing, got its head up and lost ground.

Race 4: Davis Family Group Class 6 Plate – 1400 metres
1st – KANETOSHI KING 2nd - NAYNAY 3rd - LA SALLE 4th – KHATAAF

In the early stages KHATAAF (B. Stewart) over-raced.

Race 5: Rowan’s Body Works Class 5 Handicap – 1960 metres
1st – ZEDMATIC 2nd – KALGOORLIE KID 3rd – TROPICAL ILLUSION 4th – PERIQUE

After being placed in the barriers EBOR (B. Stewart) became fractious and broke through. The horse was quickly restrained, examined by the Club’s veterinary surgeon and cleared to start. EBOR then proved difficult to reload. At the same time TROPICAL ILLUSION became fractious, resulting in its rider, Jockey D. Simmons, being struck on the head. Jockey Simmons was examined by the Ambulance Officer and cleared to fulfil his engagement. A post-race veterinary examination of EBOR revealed that the gelding had a swollen right eye.

COUNT THE COST (P. Cullen) was slow to begin.

KALGOORLIE KID (A. Spinks) began awkwardly.

For a short distance near the winning post on the first occasion COUNT THE COST (P. Cullen) over-raced.

At the entrance to the straight COUNT THE COST (P. Cullen) had difficulty obtaining clear running.

Rounding the home turn EBOR (B. Stewart) was inclined to hang out and near the 100 metres BEAU SAM (App. M. Hellyer) became unbalanced when tightened for room between SHINING CHARM (D. Green), which shifted in slightly, and EBOR, which hung out.

Following the race Jockey D. Simmons was examined by the Ambulance Officer and acting on his advice, stewards ordered that Jockey Simmons be stood down from his further engagements.

Race 6: Flexihire Class 3 Plate – 1200 metres
1st – ZULU DAWN 2nd – FLY TO WIN 3rd - GENERAL MACARTHUR 4th – DISREPUTE

When Jockey D. Simmons was indisposed following Race 5, F. Edwards was substituted as the rider of DIAMOND PURSUIT.

Leaving the 800 metres GLOBAL SPIN (D. Green) raced in restricted room between FROG DANCE (A. Spinks) and DIAMOND PURSUIT (F. Edwards), which shifted in and away from PROVOCATION (C. Whiteley).

At the top of the straight DIAMOND PURSUIT was held up and unable to obtain clear running, then near the 300 metres was inclined to lay in away from heels and had to be checked when attempting a narrow run between PROVOCATION and MONA STAR (P. Cullen).

MONA STAR (P. Cullen), DIAMOND PURSUIT (F. Edwards) and PROVOCATION (C. Whiteley) raced wide throughout.

Race 7: Professional Investment Services NQ Amateur Sprint Open Handicap – 1200 metres
1st - GUNNERS BARRACKS 2nd – ANDAMON 3rd – BAZZOOKA 4th - PERUGIN THOUGHT

The start was delayed when HIGHONRUM lunged forward after being placed in the barriers and dislodged its rider, Jockey J. Felix, who suffered a harmless fall.

EXPECTING (A. Spinks) raced wide early.

From the 400 metres until near the 200 metres BAZZOOKA (D. Crossland) was held up and unable to obtain clear running.

ANDAMON (L. Dillon) raced wide throughout.

When questioned about his riding of SEQUESTRATE, which was having its first start for trainer Mr D. Durand, Apprentice M. Hellyer explained that in accordance with his instructions, he rode the gelding more forward than had been the case in its previous starts when it had not finished off its races. Mr Durand informed stewards that at its future starts SEQUESTRATE will be ridden forward if possible.

Race 8: CAT Rental Power Class 2 Handicap – 1400 metres
1st – STAR TASSLES 2nd – MAD MUSIC/ALYTAAT (DH) 4th – PIERES

The explanation tendered by Trainer Mr R. Purcell for the late declaration of Jockey P. Cullen as the rider of RANMOORO was accepted.

When Apprentice J. Wood was indisposed and no suitable replacement rider was available, stewards ordered the withdrawal of DEVI GARH at 3.08 p.m.

When Jockey D. Simmons became indisposed after riding in Race 5, G. Kliese was substituted as the rider of ANY GOOD.

BLACK SEQUIN (L. Dillon) blundered on jumping.

Shortly after the start MANUSCRIPT (G. Cullen), ANY GOOD (G. Kliese) and BRAVE TESTIMONY (T. Bannon) were tightened for room between BLACK SEQUIN (L. Dillon) and BEAUTIFUL MARY (App. M. Hellyer), which shifted out away from PIERES (B. Stewart).

In the early stages ALYTAAT (W. Binder) over-raced and for a short distance leaving the 800 metres hung out.

Stewards opened and adjourned to a date to be fixed an inquiry into an incident that occurred leaving the 800 metres in which RANMOORO (P. Cullen) blundered and lost its position, and ANY GOOD (G. Kliese), which was following, was inconvenienced.

LADY LESIA (J. Felix) and MICHIGAN (J. Long) raced wide throughout.
