After taking into account all of the material put forward at the initial inquiry and bearing in mind Mr Symons’ submissions, stewards found that there was sufficient evidence to warrant the withdrawal of the horse, however after taking into account the whole of the circumstances they were unable to reach the necessary evidentiary standard to proceed with any charge and, accordingly, no further action was taken.

8¢ in the dollar for the win, for the winner THANKGODFORFRANC
9¢ in the dollar for the place, for the winner THANKGODFORFRANC

8¢ in the dollar for the place for 3rd, USURPER
Trainer W. Pomfrett will be advised that he must furnish a barrier certificate before PALEO will be permitted to race again.
The declaration of correct weight was delayed to allow Jockey T. Bannon to view the official patrol films. Having viewed the films Jockey Bannon, the rider of FROM THE DARKNESS which finished 4th, lodged an objection against USURPER being declared 3rd, alleging interference at approximately the 900 metres. After taking evidence from the parties involved, viewing the official patrol films and acting on their own observations, stewards found that at about the 900 metres FROM THE DARKNESS (T. Bannon) shifted in and away from POUSSIN (M. Abe), then over-reacted and made contact with the running rail. In the circumstances the stewards were unable to attribute responsibility for the incident solely to USURPER. Accordingly, the protest was dismissed and the placings ordered to stand.
Near the 1100 metres TRIVIAL (T. O’Hara) commenced to shift in, however Jockey O’Hara attempted to relieve the pressure on runners to her inside. At the same time OUR HUSSLER (A. Coome) shifted in and away from TRIVIAL, and also at that stage USURPER (B. El-Issa) improved to the inside of OUR HUSSLER, then shifted in onto FOREBODING (J. Babarovich), which had to be checked and lost considerable ground. In the circumstances stewards deemed that the actions of Jockey O’Hara were not careless. In determining its findings stewards took into account the racing manners of USURPER.
THANKGODFORFRANC – Approaching the 200 metres laid in despite the efforts of its rider and hampered another runner. Rider was advised that in similar circumstances he must stop riding and straighten sooner than he had on this occasion.
FROM THE DARKNESS – Hampered approaching the 200 metres.
SLEEP ON IT – Difficult to load into the barriers. Trainer will be advised that he must furnish a barrier certificate prior to the gelding being permitted to race again.
